At this point, it seems to me that Axl should just be grateful there's anyone out there still interested. "Financial loss" my Great Aunt Fanny. The guy should have been arrested for making really bad music available.

Honestly, I think that filesharing should be a legal form of discovering new music with the idea that you will delete it and then buy the stuff you really like. Consider that sales actually went up when Napster was at it's peak. And they didn't really fall until the labels started suing people.

Laws and morality are two different things. They intersect in two ways. The first is that moral people follow the law as long as it is not unjust and that we hope that the laws the government makes are moral. I'm afraid that if the current direction of this country is unchanged then there will be a growing disconnect between what is immoral and what is illegal. And yes Napster and other file sharing* services are great ways to share music and with proper safeguards would probably push sales. But artists (or more likely the labels that hold the rights to sell their music) have the right to be hard headed and not avail themselves of this promotional tool. * File sharing is the wrong term. File streaming is more like it. The user having a permanent file of the song may not be the best way to drive sales. Being able to play the song in a limited way (through a website) with the rights owner being able to take it down at any time is the way to go.

so why not change the law? I am all for sharing music but I will not let my son because I do not want FBI at my doorstep because my son downloaded music.

Because big record companies want to limit how songs can be shared. While I think they go a little overboard (to absurdity in some cases) you can't blame them for wanting to protect their investment. To be blunt the real problem is dishonesty. Most people will take advantage of any opportunity to get something free instead of using song sharing to decide which music they will purchase. If people would have been more honest (including myself but I will say I eventually bought most of which I downloaded) during the Napster craze perhaps the laws and preventative measures (anti copying software and the like) wouldn't be so strict and harsh.

Yeah, the nerve of those musicians. Expecting to get paid for their hard work. Funny how the label always gets a bad rap in these discussions, when at least part of their problem with file sharing is the fact that the artists don't get royalties for stuff that's copied from one computer to another.

Is it the same for an ipod? my son is always downloading new songs, but perhaps not since he pays for the song instead of the whole album.

Downloading from places like iTunes or Rhapsody is perfectly legal because they're paying the royalties.

I like Napster because I pay a monthly fee and can stream millions of songs for free. This has saved me a lot of money from buying an artist or album blind. And since I have "Napster to go" I can download songs to up to three MP3 players (sorry no iPods). Certain artists are ultra-mercenary in that they want you to buy every song. Not one song can be streamed for free. What I find ironic is that usually the most popular mega rich bands do this more often than the small guys, that could use the money more, usually give you the most for free. Go figure!

This law is black or white. Law makers need to examine they way the law is written and make distinctions between someone streaming music on their blog and people who download things like this to use to make a profit !

Yes, from reading the article, I believe that he more got in trouble for making unreleased music public more than making songs available. While both are still technically illegal, he violated confidentiality by releasing them instead.

They are just one example of bands that have been ripped off by the labels. Chuck D was saying that he'd love to see the death of the labels. If you really want to support an artist, go see them in concert.

The Barenaked Ladies decided to go independent with their latest release because they wanted the freedom to control their music. They do not have the marketing that they would otherwise have, but at least they are in control of their music now though.
